My question is does my spouse needs to take a break from work if he/she decides to get H4 EAD? or can we apply for Change of Status(COS) and EAD at the same time and get them approved at the same time so that he/she doesn't need to take any break? jairichi Posted February 24, 2015 Report Share Posted February 24, 2015 She can continue working on OPT-EAD till her COS to H4 along with her EAD gets approved. If her COS to H4 is approved and takes time for her EAD to get approved she has to stop working immediately after COS to H4 approval and wait for H4-EAD approval. Link to comment
JoeF Posted February 24, 2015 Report Share Posted February 24, 2015 My understanding is that the person has to be in H4 status to be able to apply for the EAD. The OPT EAD would become invalid when the H4 is approved. So, there certainly would be a gap. Link to comment
