H1 Cancelled without Prejudice still in Quota

Hi,

I had my stamped H1 Visa with a validity till July 2011. But it was "Cancelled without prejudice" during H4 stamping in the year 2009.

I entered US with H4 visa. Now I want to apply for H1.

1.Will my "Cancelled without prejudice" H1 be still in quota?

2.If it is still in quota, what is the process to obtain H1? And when can I start working?

3.If my "Cancelled without prejudice" H1 is not in Quota, Do I have to apply a new H1 and wait until October 2011 to start working?

Please suggest.
