My attorney applied for the prevailing wage using the onet code: 15-1111, requiring bachelors degree + 6 years of experience, but the wage offered is for the onet code: 15-1121, requiring at the most 4 years of experience. Now my attorney came back saying that my PERM could be audited by DOL requiring the company to provide evidence of "business necessity" for requiring more than the permitted years of experience. I have the following questions: 1) Are there only specific no. of onet job codes that qualify for EB2 or the EB2 qualification is purely defined by the job position? 2) Will such case definitely trigger an audit? Could someone share any success/failure stories for such cases? Thanks in advance. Link to comment
JoeF Posted January 25, 2015 Report Share Posted January 25, 2015 So, why does it have to be 6 years of experience? Why not 5 or 7 or any other number? Did everybody working in similar jobs have 6 years experience when they got hired? An employer can't just make up a number just to match your situation. Link to comment
