expired I 94 -dated sep 2010- have valid I 797 and I 94 Stub.

I have an expired I 94 ,dated sep 2010 , which i recieved last time when i was coming back from India in June 2010.

I had a valid Visa( valid till Sep 2010) from a different employer, but i had a new approved 797 with I 94 in the bottom from my current employer. I showed the new I 797 at port of entry,she wrote till sep 2010. I did not notice it then , but i have travel plans to India in the next 2 days .. i go get my new stamping done and re- enter US with a new I 94 will be in trouble at POE when i return? how risky would it be to leave ? I will call my attorneys tomorrow and find out but thought some of you with similar experience might help me with a suggestion ....
