Getting a visa stamp on an academic H1B, while an industry H1B is in process or is already approved

Hello All,

 This is my first time posting here and I hope someone can help me out. I am a post doc on an academic H1B visa. My visa stamp expired a year ago but my visa is still valid till the end of 2015. Now, I am applying for industry positions and assuming I get a job and the company is willing to sponsor the industry H1B visa, they will have to apply for the visa on 1st April 2015. I need to go to India in April for some family thing. But in order to come back, I will have to get my academic H1B stamped, while the industry H1B visa is still in the processing stage or is already approved.

 

So the question is, will it be an issue to get my H1B visa stamped, while I have another visa being processed? The industry H1-B visa starts on October 1st.

No issue at all. If your cap subject H1B petition does not come with an I94 then just cross the border and enter with a valid H1B visa and new I797 on or a week before 1st Oct 2015.
