invinsible1 Posted December 9, 2014 Report Share Posted December 9, 2014 Hello, My wife H1B is in RFE and I want to apply for H4 for her and she is currently on F1. Her semester is getting done next month. Will there be any issue if I apply for H4 even though her H1b application is still in RFE process. we are not going to answer the RFE. How long does the H4 application process take and she won't be out of status during this adjustment of status time period right ? Has anyone had similar kind of situation before. Please advise. jairichi Posted December 11, 2014 Report Share Posted December 11, 2014 Yes, you can file COS from F1 to H4 using for I539 along with supporting documents and fee. It will take around 3 to 4 months and she will not be considered out of status. Link to comment
