careerh1 Posted December 3, 2014 Report Share Posted December 3, 2014 Hello !! I will be completing my H1-B 6 years quota on Jan 16 2015 with Employer A. My PERM (filed as a future employee by Employer B) was certified a month ago and Employer B is ready to file I-140 in Premium. All the documents are ready for I-140 filing except the original LC without which I-140 can not be filed in Premium. I am joining Employer B as a full time on 12/15/2014 upon H1 Transfer receipt (filed in regular processing today). Considering the worst case scenario: 1. If I am unable to get the I-140 approved before my current H1 expiry date 01/16/2015, should I leave the country even when my H1 transfer is pending? 2. In the event that I have to exit the country and my I-140 gets approved after a month or so, will I be able to return back? Thanks in Advance!! Link to comment
