H4 EAD Rule

Hi Attorneys,

According to the new H4 EAD Rule , all the H4 spouses with Approved I140 will get EAD By End of January 2015

I am on H1b Visa. my husband is on H1B visa too and has I 140 approved since last 2 years. I didnt file another perm application thinking that we will get the EAD's soon on his perm application.

 

With this new rule, to take an advantage of the EAD, Do I have  to change my status to H4 and then apply for EAD or I can apply directly without changing status.?

I am sure there are many others in the same boat as me.

Any advice will be greatly appreciated.
