Spouse on tourist visa(B2), file for her AOS, while my I-485 pending

My Employment based I-485 is pending approval, PD(EB2 NOV 2006) may become current in July 2011 bulletin. My girlfriend is travelling to US on tourist visa(B2) in June, planning to get court-marriage and file for her I-485.

Is USCIS accepts this application on non-dependent visa?

Can I file for her I-485, when my application becomes current in July?

Not sure but B2 is considered as Non Immigrant Intent visa and her 485 may be denied.
