murthy1212 Posted November 23, 2014 Report Share Posted November 23, 2014 Hi, I got arrested for selling alcohol to minor in texas (TABC). This happened in 2009 , i was doing master at that time. I attended court, paid fine , was in probation for 3 months ( actually it was 1 year or so but i completed everything in just 3 months so they closed my case early). While i was in probation i went to India and came back they did not asked me any questions at POE. I got my OPT , got a job ( they did back ground check before they gave me PO and got nothing in my back ground check). I applied for my H1 in 2014 and approved for 3 years, . I came back to India before my opt expire in 2013 and working here So my question is , i want to go for h1b stamping ,i want to mention convicted in DS160 .But what can i answer if the VO asks why you are working off-campus while doing masters(F1) .Please give me some suggestions .I am planning to attend my Visa Interview at Hyderabad Link to comment

It will be very un fortunate if the VO denies your visa based on the fact that you once sold beer to a minor. I am not sure as why you were convicted of the crime. Most of the people get the case dismissed and afterwards expunged. Anyways go to the Interview with full confidence. Just assess the mood of the VO and answer accordingly. Be appologetic if they come to this point. I do not believe that they will even bother to talk about this. If they ask more just say that you were financialy not well at that time and worked there for like 2 months. Or whatever you think is better. Just do not lie to them. Because if they ask for this particular issue. Then you will have to answer anyways.... Take a dare and go for the interview. Do not think too much. Concentrate on the positives instead of negatives. Beer sale is not a crime but a mistake... Link to comment

In Texas, it is a Class A misdemeanor, which is a crime. "(a) A person commits an offense if with criminal negligence he sells an alcoholic beverage to a minor. ... © An offense under this section is a Class A misdemeanor." Link to comment

I got a citation(pink slip) for selling malt beverage(beer) to underage last year.I hired a attorney he said to attend only class to dismiss the charges. I have attended the BAR class and submitted my certificate to attorney and he send me a copy of letter and copy(DISMISSAL ) and said your charges are voluntarily dismissed and not found guilty.No charge of fine, probation or fingerprints anything. This is first my ticket in my life.Please help me i am really worried badly these days. My questions are: 1) What i have to do now legally to avoid any consequences to study and work in this country? 2) Does this "citation comes under arrest, because i never arrested nor handcuffed, i only got a citation" . 3) i am planning to go to India for emergency during F1 status, what consequences i will face when i am on F1 status. 4) What i should answer to VO and POE, if they ask about the charge.? 5) i am eligible to expunge the dismissed charges in my state.Is that right to do.Does it effect in any future GC and H1b. Most importantly does expunge helps me..? Please help me and reply to my questions. Thanks in advance. Your experience and suggestions are more important to me right now.
