Adding Spouse to I-485 requries re-filing of I-485 for the principal applicant?

Recommended Posts

Hello,

I really appreciates if anyone could respond to this question.

August 2006.

1. I was single.

2. Filed for I-140 and I-485 concurrently filed.

3. Schedule A Cap expired.

4. application moved to EB3 Cat.

April 2010.

1. New employer files I-140 in EB2 Cat and got it approved.

2. Ported the previous priority dates of August 06.

May 2011.

1. Priority dates will be current in June 2011.

2. I would like to file I-485 for my spouse.

My Lawyer tells me I need to file

1. I-485 and

2. G 235a again as my status changed from single to married.

Ofcourse my spouse`s I-485 and etc will be mandatory.

Could someone please confirm if I need to file for I485 again?

Thanks for your response.

If you have a pending I-485, you should not file another one. Just make sure your I-485 is pending based on the new I-140. Generally, if your A number is the same on all petitions, the USCIS would connect them automatically.

my 'A' number is different in I-140 approved notice and also in Receipt notice of I-485 (which is still pending).

Could anyone please tell the steps to join/make 'A' number same in all petitions?

Thank you in advance...
