H4 visa extension with arrest

Hello members,

My wife was arrested last year for shop-lifting.

She was let off with a class and court fees. My H1B is up for extension and need to file her H4 extension. There is a question on the form asking if she was ever arrested.

If we say yes on the form, will this hurt our chances of getting an extension.

Expert please respond.

I would say that the VO in India generally does not do a background check. If applying from US there might be a chance of running background check.
