I-94 extension denied and visa stamping

My H1b petition is valid upto Jun 2012 but my visa stamp already expired. So planning to go to Matamors for stamping.

Due to a situation back in 2009, I am wondering it is considered as "out of status"?

My I-94 expired in Nov 2009, applied for extension before the expiry date. USCIS denied my extension in Feb 2010. I went out of USA in Feb 2010 and came back with new I-94, got H1B extension approved.

Am I considered out of status and cannot go to Mexico/Canada for H1b visa stamping?
