Current processing times for H1B to H4 COS

Hello all,

 

Was on H1B with I-797 valid till September 30th.  

 

Applied for COS from H1B to H4 on September 10th. Received Receipt notice on September 15th. Still awaiting approval.

 

Questions:

a) Any idea, what current processing times are ? 

b) I am without a valid I-94. Can I file an H1B if I find another Job or await until I get an H4 I-797 with I-94

a. 3 to 4 months.

2. When did your I94 expire? If it expired before you filed a COS petition then your employer can still file a cap exempt H1B petition but it will be approved without I94. Otherwise you are fine to get an I797 with I94.

applied on Sept 12, its four months now, haven't got approval yet. Only got receipt back from USCIS.

Contact USCIS and raise a service request.

*** Update: Status updated on Feb 11th, that my case is approved. Awaiting postal mail with updated I-94.

Looks like it took whole 5 months for H1 to H4 Change of status. (Applied on Sept 12 th 2014, Approval on Feb 11th 2015).
