perm pending more than 365 days and it was filed after 6 years

My first PERM was withdrawn from BALCA after I got 7th year extension. My 2nd PERM was filed with same company after 6 Years max out date and it's been pending more than 365 days. I left US 1 day before 7th year petition expire date and after 6 years max out date. I know that 1 year H1-B extension Not subject to cab can be filed if PERM pending more than 365 days. My company is saying the 1 year extension can be applied because my 2nd PERM was filed after 6 years max out date and i left US after max out date. Can any one of you filed 1 year extension similar to my case? I need this confirmation at the earliest to make my final decision. Please help me!

I guess your company is telling you what could be done. I second that opinion.
