savd Posted October 2, 2014 Report Share Posted October 2, 2014 Hi, I have I129 petition (Approved from 1st Oct 2008) which was never used and I never traveled to USA. I tried to contact many employers as I have niche skillset but I was told that my cap was 6 years old and thus cannot be used for cap exemption. I have seen 100s of post/forum saying its a grey area and there were few cases which were considered under Cap-ememption. Can an employer file my H1B under cap exemption category for my case. Can you suggest any employer or attorney who has file Cap-exempt H1B in this case. Appreciate your help Link to comment
