logas_ss
Hi, I have my H1B visa stamped on Oct 8 2013 by a company A. Till now i didn't travel to US, so i have decided to switch to some other company B. I have below queries on the Visa staus. 1. Do i have to go to Conslate again for H1 transfer? 2. Do i have to wait to join company B till i get the H1 transfer confirmation from company B? 3. What will happen to my Visa if company A revokes the petition? 4. Do i have to pay any money to company A if they ask for? Thanks. Link to comment
itsmeusa
1. No 2. Yes. You would need original I-797 copy to enter US along with your existing H1b visa. 3. Doesn't matter. 4. Check the employment contract if you have signed anything that is legally binding on you. Link to comment

Till now i didn't travel to US, so i have decided to switch to some other company B. I have below queries on the Visa staus. 1. Do i have to go to Conslate again for H1 transfer? => No need. Same visa will work if not expired. 2. Do i have to wait to join company B till i get the H1 transfer confirmation from company B? => yes, you need approval and B's I797 to enter in USA on H1b. 3. What will happen to my Visa if company A revokes the petition? => Visa is ok, if old petition is revoked. You can use the same visa with a new petition approval. 4. Do i have to pay any money to company A if they ask for? => Depends on any contract with A,. But definitely you don't need to pay H1b fees to your employer. Its against the law. Thanks. omshiv
Assuming you are out of the US now. 1) Yes. If Company B files for your H1, you'll have to get it stamped at a US Consulate. 2) Depends...where is this Company B? If its in your local area..no need of waiting for H1 transfer. 3) Nothing. 4) No. I'm sure Company A is not worried about it after 1 yr. Link to comment

My bad..I read that your stamped visa is till Oct 13. You dont need another visa stamping if the current one has not expired. Link to comment

There is no status if you are outside the US. Link to comment
