student14 Posted September 29, 2014 Report Share Posted September 29, 2014 I-20 expiration date: 06/27/2014 PhD Degree conferral date: 08/12/2014 OPT-EAD application date: 08/05/2014 (e-filing, without valid job offer in hand) Currently valid start & end dates on OPT-I-20: 08/25/2014 - 08/24/2015 Job offer received date: 08/27/2014 Employer requested start date: 09/03/2014 USCIS denied EAD: 09/25/2014 My EAD was recently denied (received e-mail), I haven't yet received my denial notice stating reason for denial by postal mail from USCIS. After EAD denial, since I'm past the 60 day grace period of F-1 should I leave the country? What is my visa status at this point? The OPT I-20 is valid from 08/25/2014 to 08/24/2015. My employer, a non-profit organization might be willing to file an expedited H1B. Should I attempt a change of status from F1 to H4 based on husbands H1B while waiting to respond to USCIS denial notice by MTR and filing for expedited H1B? I don't want to accrue out of status illegal stay days. Please advise. Thanks!!! Link to comment
mathunni Posted October 7, 2014 Report Share Posted October 7, 2014 Your employer cannot file H1B until next April. If your EAD is denied, you should leave the country ASAP. Link to comment
