praju
Hi I work for company A and there exists a vendor B who introduced me to client C. Client C is very much interested in hiring me directly for full time and same with me too. But Client C has some agreement with B and B has agreement with A. I also have non compete agreement with A. Client went ahead and requested NOC with B so that they can start H1B transfer But they said.. they cannot give it as it is against contract. Now what options do I have ? 1. Client cannot initiate the h1b transfer till NOC is given by B. So C terminating the contract with B and eventually with A will put me on bench. So then can H1B be transfered and can I join C? 2. Can I resign from A so that all the contracts gets void and I can join Client C ? 3. What other options do i have ? Cheers Link to comment
jairichi
Your ideas will not work that easily. You need to talk to a good labor attorney. Link to comment
JoeF
Contracts you signed don't become void by resigning from the company. Link to comment
omshiv
You'll need to see what the contract says..I dont think so its easy to leave A and join C. B will sue you...check the contract with an Attorney. Link to comment
wiweq
Ideally the client should buy you. Means they should pay money to B to hire you, so that B would let you go. In business, no one does 'favor'. Link to comment
