H1B to J2

Hello grp,

 

I am currently on my H1B visa with EB2 PD date Sep, 2010.

 

If I switch to J2 (on my wife J1, which is good till July 2016)

 

- How long does it take for change of status from H1B to J2 ?

- During the transition period, can I continue working ie on H1B ?

- Once J2 is approved, how long does it take to get EAD ?

 

And the most important Q:

 

- After July 2016, Is it possible to change status from J2 (H4 with J1 waiver) and then to EB2 via 485 if dates become current in 2016 ? 

 

The reason for EAD craving is for finding a position near my family.

Everything looks good...but I don't think you need to submit COS for H1 to J2...If you see I-539 they did not mention about this...and you can leave your H1 so that you can use it to come back in the future in case you need...for example your wife waiver may be in trouble or delayed or You or she got stuck in India for stamping....I am almost in the same boat....plz let me know if an attorney asked to do COS...
