swathisfantasy Posted September 17, 2014 Report Share Posted September 17, 2014 Hi Friends, Please help me out. April 1st 2014 - Applied H1B while am on CPT. April 30th 2014 - CPT ended June 23rd 2014 - OPT approved ( OPT ends on June 22nd 2015) Aug 6th 2014 - Received my status from USCIS - H1B approved and COS denied. Reason: "USCIS has determined that the record does not meet the preponderance of evidence standard demonstrating that the beneficiary maintained his F-1 status because he was not enrolled in a CPT program that was in accoedance with 8 CFR 214.2(f)(10)." I got confirmation from my DSO on Aug 23rd 2014 that my OPT is still active now. My questions are: 1. What will be my status after September 30th? Is my OPT active till June 22nd 2015? 2. Do I need to go for stamping immediately? or do I have time till my OPT expires that is June 22nd 2015? 3. Can I use my OPT now and go for H1B stamping later (before my OPT expires)? 4.
