L1 to H1 transfer was approved but we did not receive the I-94 even though it was specified in I-129 petition that we applied for a change of status (COS).a) How can we get the I-94 for this new H1 filed by Company B without leaving US? The H1 approval is valid from Oct.1, 2014.My L1 visa through Company A is already expired & I'm staying here on valid I-94.b) My company A is applying for L1 extensionWhich visa (L1 or H1) remains in effect in this situation? Can you please guide me what to do without leaving US?I appreciate your quick responses since I do not have sufficient time!!Thanks Link to comment

itsmeusa Posted September 17, 2014 Report Share Posted September 17, 2014 In your case your H1b petition is approved, but not change of status, hence I-94 was not attached. a. You must exit US, appear for H1b visa interview, get H1b visa and re-enter US on that visa. Then you would get I-94. b. If you get L1 extension approved now, you would be counted towards L1 only. You would not get H1b status unless you do steps in a. Link to comment
