However he get a job in next 1 month after filing H4 and files for H1B with new company in premium while H4 is pending. Then what is the process, to make sure that H4 petition is approved followed by H1b? Please share some insight. Link to comment

wiweq Posted September 11, 2014 Report Share Posted September 11, 2014 This happened to me in 2011. I has laid off on H1b. My wife was also on H1b. On the day of lay off I filed online I539 COS to H4. In 10 days I got the receipt. In next 5 days I got the offer. They filled my H1b with my H4 receipt and previous H1b approval. This PP H1b approved in 15 days. By that time, H4 was pending for 1 month. I called to USCIS to cancel my H4. As per their instruction, I wrote an application to USCIS to cancel my H4, as I already got valid H1b status, attached the new H1b I797. In 2 weeks, I got the confirmation that H4 is cancelled.
