anuscaria
I got a new H1B on May 2010 and it got extended to June 2014. I worked in the United States for one year and went on vacation to India. When I went for stamping ,it got rejected in Dec 2011, Now I am back in US in H4 visa. I read in some forum that i will not be subject to the visa cap as I will have been counted in the visa cap within the past 6 years. Is it true? Does it hold against my case? Link to comment
jairichi
Yes, you are cap exempt till you reach your max allowed stay of 6 years on H1B. Link to comment
