knightraider79 Posted July 26, 2011 Report Share Posted July 26, 2011 -------------------------------------------------------------------------------- Hi all, I have received a RFE from Texas service Center for I-140 filed under Premium Processing t-day, lawyer has replied to RFE (needed signature from attorney who file PERM, I-140 was signed and prepared by a different attorney in the same law firm... it doesn't make sense though). My question is will USCIS make decision within 15 calender days from RFE replied date or premium processing doesn't apply for RFE case. Thanks Kumar. Link to comment

Attorney_15 Posted July 27, 2011 Report Share Posted July 27, 2011 The terms of premium processing service are 15 days for an "adjudication," which is a denial, approval or RFE. Once the RFE is issued, the clock stops and restarts counting 15 days once the RFE response is received. From time to time though cases take longer since they have been taken out of the PPS queue and then people often have to go thr route of a lawsuit to force a decision from USCIS. Link to comment

Initial application date : 07/15/2011 (under Premium processing) RFE received : 07/26/2011 Replied : 07/26/2011 Approved: 08/08/2011 Good luck everyone on their GC application Kumar Link to comment
