I did not use my H1B visa issued from Feb 23rd, 2009 to Sep 26th, 2011. Am I eligible for cap exempt?

I am currently living in India. Due to some family reasons, I did not use my H1B visa to come to US in 2009. If I want to come to US, Do I need to wait until April 2015 to apply for H1B? or Am I eligible for cap exempt because I did not use my visa at all?
If I am eligible for cap exempt, what do I need to do to get new visa?

You are cap exempt. An employer has to file a cap exempt H1B petition. On approval, with a valid H1B visa and I797 you can enter US.

As you have gone through cap once you are eligible for cap exempt....

You need to find an employer to file for you H1b and get your visa stamped upon approval..
