H-1B Transfer

Hi There,

 

My petition got approved long time back and have a visa which is expiring in Sep'15. I didn't entered into USA till now and not sure whether my current company have plans to send me onsite.

 

I checked with employer who is ready to transfer H-1B. But he said travel to USA with the current visa and as soon as you enter into USA, I will file a petition for transfer.

 

Please let me know if this a valid case? Let me know your thoughts.

Do not do that. You will be deported back to home country at POE. New employer has to file a cap exempt H1B petition and on approval you can travel to US with a valid H1B visa and I797 (petition approval notice).
