semr
Hi, My wife has filed a IPC 498A(Dowry Harassment case), 3&4 DP Act(Dowry Prohibition Act), 323(Voluntarily Causing Hurt) & 506(Criminal Intimidation) false cases against me in this year in India because of which i was arrested and sent to judicial custody based on accusations and not on trial. In the meantime, i got my H1B petition approved for the first time in my life. i have travelled to USA previously on B1 visa. In DS-160, there is a question " Have you ever been arrested or convicted for any crime, even though subject of a pardon, amnesty ? What should be the ideal answer for this question because chargesheet is yet to be filed and trial is yet to start. Any other suggestions, please let me know. Thanks Link to comment
rahul412
You have been arrested, so that will be 'Yes'. During the interview just answer the truth. Link to comment

I have couple of more questions 1. What case documents do i need to carry at the time of interview. 2. what is the probability of visa getting approved ? Link to comment
JoeF
You need to get a lawyer. As the old saying goes: "He who defends himself has a fool for a lawyer." Link to comment
JoeF
Oh, and obviously, a divorce would be in order. There obviously is nothing you can do to fix this. Link to comment

GcLLC
Assuming you can get a Visa, are you free to travel? Best solution is to contact Murthy India and a good criminal lawyer (in India) and get the matters resolved before you go for interview. Link to comment
