Laid off after H1B approval 2 weeks to Cap-Gap start

Hi,

 

I have an approved H1B petition, but my employer laid me off. My EAD expired in 2 weeks after that I will be on Cap-Gap. I have not yet used my STEM extension.

 

I wanted to ask if it is possible to apply for STEM extension while having an approved H1B visa. Or I can ask my employer to revoke my H1B petition but that may take more than two weeks after that my Cap-Gap will start. Can you apply for STEM extension in that case.

 

Also, if STEM extension is not an option and i am able to find an employer who is willing to file another cap exempt petition for me. Since I may have been unemployed for more than a month. Is that going to affect the H1B application.

 

Please guide me through the process. I am in need of urgent help.

Not sure about STEM ext, but this should be fine. Another employer can file your H1.
