Based on the findings from the internet and USCIS site the processing time is around 2-3 months. My question is whether I can apply for an H4 extension simultaneously while the COS is still pending. My H1 and my spouse's H4 are expiring in 3 months and my employer will have to file an extension soon. Please suggest. Link to comment
jairichi Posted July 16, 2014 Report Share Posted July 16, 2014 If extension of H4 happens after COS from H4 to F1 then according to last action rule she will move back to H4 status. So, let employer file extension only for you and not your spouse. Link to comment
ronesha Posted July 17, 2014 Report Share Posted July 17, 2014 Hello everyone, I am currently working with my OPT permit that will expire August. I have to change my visa status from F1 to H4. I have currently applied for a new passport, and that will take a couple of months still. Will it be okay if I submit my I-539 form with the expiration date on my previous passport, and then later submit my renewed passport date? How should I go about handling this situation? Thank you.
