kencian Posted July 8, 2014 Report Share Posted July 8, 2014 My priority date became current December, 2013. In March 2014 RFE was sent for I-485. My attorney did not respond to RFE until a week before the 87th day deadline given by USCIS to respond. By this time, there was a retro of 4 month back from my priority date. I kept checking the USCIS website, but it is still saying 'RFE response received and is being reviewed'. Does, anyone knows if I have to wait for my priority date to become current again before they make a decision? Attorney is of no help, as she already got all of her money, she does not return calls and its three weeks now that I have been emailing her, only to find out that she is out of the USA for a month on vacation. Any help will be greatly appreciated. Link to comment
JoeF Posted July 9, 2014 Report Share Posted July 9, 2014 They can't approve a case unless the PD is current. They can process things (and could issue a denial), but approval requires a current PD. Link to comment
