Consulate or extension within USA for non immigrant visa

Hello ,

 

I have one shoplifting conviction on my record ,which falls under petty offence .

 

As my visa is expiring which option is less risky

 

1. Extension of status with in USA ( risk- extensions denial rate is higher with USCIS) 

or

2. Going to Consulate 

 

Is there chances of getting petty offence exception at consulate ? Has anyone got it in India ?
