H1B situation

Hi,

 

My company recently did a mass lay off and I lost my job, I have one more year of H1B till Jun 30, 2015. My labor was approved last May with my old company. What is my current situation about my H1 and can i use my approved labor to extend my H1 for one more year?

You are out of status from the day you were laid off. If you recently lost your job you can apply for a COS to B2 and look for a job. Unfortunately approved labor will not give you extension beyond 6 years on H1B.

start looking for jobs immediately but before doing that do COS to B1/B2. Your new employer will have to restart your GC process.

COS to B2 ASAP.

You need I140 for H1 ext, not just approved labor.

I have another labor processing in BALCA for more than 365 days? Will that make it extend for more than one year?
