phmx Posted June 26, 2014 Report Share Posted June 26, 2014 Hi guys, I desparately need your help. I have a query on my H1 asking to prove that I am maintaining status. I have all the proofs except that my employer who is sponsoring CPT has COOPERATIVE agreement with my college. I don't have anything like that and my employer who sponsored my CPT is different from the one who filed my H1 and my current employer (when on CPT) does not know that I filed my H1 petition with other employer. so I cant ask him for the agreement and eventhough I ask him, I think he will not give it as I will be moving to new employer. So, is there anyone who faced / facing the same situation. If so, please let me know what approach is.. Thank you so much.. Link to comment
rahul412 Posted June 26, 2014 Report Share Posted June 26, 2014 First, CPT cannot be sponsored. Second, is your CPT part of your F1 program? Third, are you currently working Full time in CPT ?? Anyhow from Oct 1st you will be working for your H1 employer, so what's wrong in asking agreement?? Link to comment
JoeF Posted June 26, 2014 Report Share Posted June 26, 2014 This looks like abuse of CPT. CPT is only for work as integral part of the curriculum, and it seems that wasn't the case here. USCIS knows about such CPT abuse, that's why they issue RFEs. Link to comment

t75 Posted June 28, 2014 Report Share Posted June 28, 2014 Did you previously have an OPT? If so, the CPT looks like a plan to remain and work in the US until you got an H1B. A lot depends on the college being legitimate. Link to comment
