H1 Transfer Question

Hi,

 

I left company A and joined company B upon H1 transfer receipt notice. My company B delayed transfer by 5 business days due to delay in LCA approval. And now I got RFE asking employer-employee relationship, payslips for the gap period & cleint letter.

 

NOTE: Client is not willing to provide cleint letter so all I have is vendor letter.

 

Here are my questions -

 

1. Can I apply for H1 transfer to company C based on H1 receipt for company B or do I need to wait till I receive approval/denial for company B H1 transfer.

 

2. My spouse is also here so if rejected do I need to leave country or can I apply for COS to H4

1. No need. You can do it with A's H1 approval.

2.You can file for COS.

1. Yes, employer C can and it will be considered as bridge petition.

2. You can apply for COS to H4 right immediately after denial.
