ashok123456 Posted June 20, 2014 Report Share Posted June 20, 2014 Hello, My current 797 is expiring on Sep 17th, 2014 and I don't have a visa stamping for that. I applied for my extension under premium processing. Now, I am planning on travelling to India on Aug 1st and return on Aug 31st. During that trip I am planning on going to my visa stamping. My question is based on which 797 I need to go to my visa i.e. current one or wait for the new 797 (assuming it gets approved). If I apply with my current 797 and if I was given visa till Sep17th then is it OK to enter US on Aug 31st? (or) If I apply on my new 797 then I think I will be given visa starting from Sep 17th(?). In that case is it OK to enter US 17 days prior to visa start date? (or) Can I apply on my current 797 and during the interview process show the new 797 form to visa officer for considering visa stamp till end of new 797 expiry date? Please advise which one is best option and why. Thank you! Link to comment
omshiv Posted June 21, 2014 Report Share Posted June 21, 2014 better to take the new one..since you have already applied on PP and your travel is in Aug, you have enough time for the decision of H1B.....although it doesnt matter as you can always show your new 797 at POE. Link to comment
