LCA vs offer letter salary

Thanks for your reply... Just for my confirmation - So Employer should pay minimum pay of proffered wage to Employee in 1 year. 

My case, LCA Prooffered wage is 71k & offer letter also 71k but w2 for 2013 year is 65.5k (Prevailing wage - 55k). 

I requested my employer to match LCA amount in 2013 year pay but he just convenienced me saying if I get more than prevailing wage would be fine.  Can I get the remaining salary ( 5.5k = 71k - 65.5k) if I contact DOL. I have all paystubs, LCA, W2 forms. 

 

Appreciate your help.....

If you have a signed contract for a specific wage, see an attorney. Prevailing wage is what is required. It does not appear from what you have posted to be a DOL problem. They take longer than a private attorney addressing a contract issue as well.

Thanks for your reply... I didn't put my question properly earlier.

 

My question - I am working on H1b visa. My employer did pay less that what he mentioned on LCA & Offer letter.

In this case, does DOL or USICS will help me to get the remaining salary from him. Now I left that company and joined in another company on H1B visa.

You need to get at least the salary listed on the LCA, which has to be at least the prevailing wage.
