Enter US during H1B transfer in RFE status

Hi Experts,

I had my H1B stamping done by Dec 2013 and entered US  by Jan 2014 and I was working there till March 2014.  I came back to India by April 2014, got on offer from another employer, they filled H1B transfer and the current status is in RFE. I have following queries in my mind.

 

1. Is it legal to travel back to US as I have valid I-94?

2. What will happen to my old H1B visa if my transfer is rejected ? 

3. If I have decided to stay with my current employer is there any problem in entering  US with my old H1B ?

1. If you are joining the other employer then you cannot.

2. Visa will stay in your passport.

3. No.

Your I94 is NOT valid. It was terminated when you left the country.
