visaqry Posted May 22, 2014 Report Share Posted May 22, 2014 Hello - Need some help good folks! Here's my situation - I will be completing 5 years as a Permanent Resident in August, 2014. I got divorced after 2.5 years in marriage and so I needed to wait for 5 years to meet the eligibility requirement for Naturalization. Here are my questions - 1. Can I still apply for Naturalization in May, 2014? This is based on the fact that one can apply for Naturalization 90 days in advance. 2. After I file N-4000 and during the Naturalization process, if I get married, will it affect the Green Card process or K3 visa for my wife post my Naturalization? or is it recommended for me to wait for marriage until I get naturalized? JoeF Posted May 22, 2014 Report Share Posted May 22, 2014 You can file an N-400 up to 90 days before fulfilling the continuous residency requirement, provided that all other requirements are fulfilled. When you marry doesn't matter for GC of the spouse. Link to comment

JoeF Posted May 22, 2014 Report Share Posted May 22, 2014 I should qualify my last sentence: Filing for a GC for the spouse while still being an LPR of course means a delay for the GC, since the PD isn't current. Once you are a USC, there is no quota for the spouse. Link to comment
