akshat85 Posted May 22, 2014 Report Share Posted May 22, 2014 I am on L2 EAD currently in USA. My H1B petition got approved (2015 Quota - valid from Oct 1, 2014) from employer A. I got good offer from employer B using my EAD, but employer A threatens he will revoke my petition if i leave him. I have h1b approved receipt number but no i797 doc. Employer B says he need i797 doc for transfer. What options do i have? Questions : 1) What will happen if employer A revokes H1B petition. 2) Can i do transfer with using receipt number. 3) Will there be cos from October 1? Please advice. Link to comment

File a FOIA with USCIS to get your approval notice. Even if employer A revokes your H1B petition it will not prevent employer B from applying a cap exempt H1B petition anytime. Link to comment
