madmen Posted August 23, 2011 Report Share Posted August 23, 2011 I have been with the same employer for the last 5 years. I will soon be entering the 6th year on H1B status. The first time my employer's lawyers filed for Labor Certification, the application was audited and then rejected. The new application for Labor Certification was filed recently. If I change jobs, say in the next 6 months, and my Green Card situation does not change, A) Will it be possible for my new employer to get an H1B for me? B) Or do I need to reach a certain stage in my Green Card processing before a new employer can file for an H1B for me? C) Will the new employer need to start my Green Card process quickly before full 6 years of my H1B expire? Link to comment
