What kind of risk I have if I start working with H1-b filling receipt. I have pending I-485 under EB-3 and trying to file EB-2 with new employer. Please advise Thank you Link to comment
Attorney_7 Posted July 10, 2011 Report Share Posted July 10, 2011 Generally, under AC21 portability, one is allowed to work for a new H1b employer upon filing the petition as long as certain requirements are met. However, if the Change of Employer petition is denied, the Beneficiary must immediately stop working. This could result in falling out of status if the old employer’s H1b petition has been revoked or the Beneficiary is not able to return to the older employer otherwise. Link to comment
