RFE55 Posted September 14, 2011 Report Share Posted September 14, 2011 Hi My H1B approved on dec 2nd 2010 and started working in the desi company. but i got paid by the company in Feb 2011 2 nd week . W2 was not generated for 2010 becos i got paid in feb 2011 in the paystub pay date is Feb 2nd week 2011, there was delay in first 2 months pay date but after that it was regularized. in Aug while transferrring H1b to other company got an RFE about recent paystubs & submit all W2's .I have all the paystubs but dont have the W2 do we need to submit the W2?? or how can we prove to USCIS we dont have W2?? Attorney_23 Posted September 15, 2011 Report Share Posted September 15, 2011 It does not sound as if the problem is going to be convincing the government that you do not have a W-2. The problem is that you went unpaid for 2 months, and therefore the government may deny the extension. I would recommend contacting an experienced attorney to assist in filing the response to the RFE. Link to comment
