Can she apply for visitor visa and come stay with me for three months and when I get H1 will she have any issues while attending for H4 in future. Please suggest me on the same. Thanks in advance. t75 Posted May 19, 2014 Report Share Posted May 19, 2014 Why was she denied - finances or 214b? H4 has different rules than F2 or B2; once you are on H-1B she will be judged based on that job and your H-1B approval. Link to comment

Why doesn't she want to wait those 3 months and then join you on H4? This is so easy compared to applying for B2 as her F2 visa was rejected twice. Link to comment

Reading your post I am guessing you are intended to use visitor visa to bring your wife to stay with you & certainly not for documented VISA purpose. Moreover if your wife cannot justify visitor visa requirements or questions asked during visa interview then it may pose an issue. It would be good if you can wait for 3 more months till you get H1 and then try bringing your wife on H4. That way it will be clean & safe process. All the best! ~thumbad Link to comment
