L1 to H1B transfer

Hi,

I was having H1B petition valid from Oct 2007 to Sept 2010. I didn't use this visa.

Now I am on L1 visa and would like to change my status to H1.

Is possible to use the old H1 petition without waiting for new H1 cap?

If possible please let me know the procedure.
