I graduated with a Masters in IT in December 2013.

My OPT application was denied because my SEVIS was more than 30 days.

I have a full time offer from ***** as a Software Engineer in USA.

I am currently in India. ***** filed for my H1B and it has been picked in the lottery.

I got an joining date extension and I am currently scheduled to join on October 1st.

So If i want to go back to US and start my job, I have two options :

1) Go for H1B stamping in India and join ***** on H1B from October 1st.

2) Get a new i20 from xyz university for a new MS, and go to USA on F1 visa, then drop out of the program and join ***** in October. This way I don't have to go for stamping.

What are the risks associated with H1B Stamping ?

Which option is better ?

1. That is the proper way.

2. You might end up having trouble taking this route.

You have only ONE option, get your H1 visa and enter into US on H1.

Forget about this F1 misuse, if not you have to forget US forever

It is irresponsible for you to take entry into school in order to enter the country.   Why are you afraid of stamping? Are your credentials fraudulent?

You do realize that you will be liable for tuition to the university.  If you do not pay it, they will either sue you for payment or report it to the credit bureaus.
