I had a question to see if there is a minimum number months/days that need to be remaining on the H1B for the new employer to initiate the H1B transfer? 2. The new employer will file for my Green Card on Day 1, however since it is less than 365 days before my H1B extension for how long do I have to leave the country? Thanks so much for your help. Regards 1. No. 2. Only with a pending PERM or I-140 for more than 365 days or an approved I-140 an employer can ask for extension after your 6 years H1B. Link to comment
