Expiring H1 Vs Valid I94

Hi,

 

I got a basic question. My H1 is expiring in next couple of months, whereas my I94 is valid till mid of 2015. I94 indicates the validity of stay in US. In that case if I do not extend my H1, can I still work in US till my I94 validity ?

H1B visa is an entry document. Your stay in US on H1B status is based on your H1B petition validity and I94. If any of this is due for expiry then your employer needs to apply for extension.

Technically, both 797 and I94 should expire on same day.

How did you get I94 beyond 797 expiration date.??

 

You should have some status to stay in US after 797 expires. It doesn't matter even if your I94 is still valid.

Employer has to file for extension before petition expiry date as an I94 is not good without a valid H1B petition.
