If so what is the process Just as FYI do note that I posses valid L1 visa now and thought assume it will not have any impact. Additional question is that can an individual have L1 and H1B visas at the same time?? Link to comment

Additional question is that can an individual have L1 and H1B visas at the same time?? An employer can file a cap exempt H1B petition anytime and you will get 6 years - time spent in US on L1. rahul412 Posted April 30, 2014 Report Share Posted April 30, 2014 It's been 5 yrs, I guess that 797 should be expired by this time. Your new employer can file H1 under cap exempt. And yes, a person can have both H1 and L1, but can enter into US only on ONE status. Link to comment
