sv2427 Posted September 20, 2011 Report Share Posted September 20, 2011 My employer filed my H-1 on May 19th 2011 at VSC. I'm on H4. The status is still showing initial review. I have not received anything so far. Just hoping it gets approved. Link to comment

My receipt date is also 19th May .. I suggest you to contact your attorney/employer and have them call USCIS as its been long time , you will defineately know something.. Link to comment

visaseekerUS Posted September 23, 2011 Report Share Posted September 23, 2011 @sandyamol123, If your I797 is not attached with I94.( it means that COS is not applied) Then n then only you need stamping. Even you can apply for Change Of Status as well if you do not want to get stamping. If I797 is with I94 attached, then no need to apply for COS or stamping. Link to comment

RFE Responded : 3rd week september Still my case status not changed to RFE response review still its showing RFE status only. I heared they slow down the process of H4 to H1 not for H1 visas for L1B visas tooo..... Link to comment

They said , I will get the decision before October 29th . Visha , my RFE was: E'er-E'ee relationship,my control of work by my employer ,my H4 approval copy and my spouse H1B copies and his paystubs of the month my H1B was applied ( to prove that my spouse was with that company and working at the time my H1B was applied) We replied to everything in detail. I have applied for my wife's h1b as stated above( 29th July) she is currently on h4 visa. But currently she is in India for one month vacation mostly likely she will be back by end of November. We did not aware that she would have to go for h1b stamping if her h1b gets approved while she is in India? Or she can come back here on h4 as she is hold h4 visa until may 2012? The current status of her processing is "initial Review" Please do advise what are the prons and cons if her h1b gets approved while is she is in India. H1B2012 Posted October 20, 2011 Author Report Share Posted October 20, 2011 Hi As far as I know , if one travels outside US when COS is pending , the pending application is abandoned ,one can either travle after it is approved /before it is applied ,but not during the process. Please consult an attorney immediately , i think there is some complication here ,I am not sure though . My Attorney and Employer adviced me not travel when the application is pending .... jasmine1986 Posted October 20, 2011 Report Share Posted October 20, 2011 In my opinion it is better if she come back to US with H1 stamped if it is approved while she is in India.If her H1 is approved after she come back to US on H4 say after November,even then she should leave the country and get her H1 stamped in order to work here.
